Welcome to Mementi! These Terms of Service (“Terms”) govern your use of the Mementi specific mobile application (the “App”) and any related services provided by us.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this eligibility requirement.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

The App allows you to create diaries and posts using your photos and text (“User Content”). You retain ownership of your User Content.
The App uses Artificial Intelligence (AI) to help generate content. You acknowledge and agree that:

We reserve the right to suspend or ban users who violate these guidelines.
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Generation uses Apple Foundation Models and requires iOS 27 or later, a supported Apple Intelligence device and region, and the downloaded system model. Availability and supported languages may change with Apple’s services. No Mementi account or model API key is required.
Photos are analyzed on the device. Writing starts on the device and may use Apple Private Cloud Compute (PCC) when a request exceeds the local context budget and the user has enabled PCC. PCC processes photo summaries, available date/place information and text excerpts through Apple; original photos are not sent to PCC for generation. Users can disable PCC in Mementi Settings.
Mementi does not sell app credits, subscriptions or generation packages. PCC requires internet and is subject to Apple’s daily usage limits, eligibility rules and service terms. Apple may offer additional usage options through its own system interface. Mementi does not guarantee PCC availability, usage allowances or output quality. Cancelling a request or receiving an unusable result does not establish that no Apple service usage occurred.
This version no longer uses Mementi credits as a generation requirement. Historical purchase records are not automatically erased or converted into another service’s funds or usage. Upgrade cleanup removes the retired local model credential and preferences; it does not revoke remote credentials or delete data held by previous providers. Contact support concerning past Mementi purchases. Applicable consumer rights and Apple purchase policies continue to apply; this change does not promise an automatic exchange or refund.
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
We are not liable for any damages, losses, or distress resulting from the use of, or reliance on, AI-generated content. You understand that AI models can behave unpredictably.
Synchronization features depend on your device settings (e.g., iCloud Keychain and iCloud Drive) and Apple’s infrastructure. We do not warrant immediate synchronization, constant availability, or error-free operation of sync services. Conflicts may be resolved by last-write-wins or similar mechanisms.
You agree to indemnify, defend, and hold harmless Mementi, its developers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:
We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law provisions.
If you provide us with any feedback, suggestions, or comments regarding the App, you grant us the right to use such feedback for any purpose without restriction or payment to you.

Certain features rely on Apple iCloud services to store and synchronize data across your devices. Your use of these features is subject to Apple’s terms and privacy practices. Enabling or disabling iCloud services may affect availability of cross‑device features.
